This document (“Terms”) governs the access to and use of WrightCare.in and all related services, communications (including phone and WhatsApp), and mobile applications (collectively, the “Platform”), owned and operated by Ankira Infotech Private Limited (“Company”, “WrightCare”, “we”, “us”, or “our”).
By accessing, registering, or using the Platform, you agree to be legally bound by these Terms. If you do not agree, you must discontinue use immediately.
Definitions
For the purposes of these Terms, a “User” or “Customer” means any individual accessing or using the Platform. A “Service Provider” means any independent third-party professional or business listed on or connected through the Platform. The term “Platform” includes the website, mobile application, WhatsApp, call-based services, and any digital interface operated by the Company. “Services” refers to listing, booking, facilitation, coordination, or connection services offered through WrightCare.
Company Ownership & Control
WrightCare is a proprietary technology platform fully owned and controlled by Ankira Infotech Private Limited, a company incorporated under the Companies Act, 2013. All rights, title, and interest in the Platform, including software, design, layout, database, trademarks, brand name, and operational structure, are exclusively owned by the Company.
Nothing in these Terms shall be construed as transferring any ownership, license, or rights to Users or Service Providers except a limited, revocable right to access and use the Platform.
Use of the Platform does not create any relationship of employment, agency, partnership, franchise, or joint venture between the Company and any User or Service Provider.
Nature of Platform (Aggregator / Intermediary Model)
WrightCare operates as a technology-enabled aggregator and intermediary platform that facilitates connections between Users and independent Service Providers.
The Company:

Does not provide, perform, or supervise services

Does not employ or engage Service Providers as employees

Does not control how services are executed

Does not guarantee service quality, outcomes, or timelines
All service agreements are strictly between Users and Service Providers. The Company’s role is limited to facilitating connections and communication.
Eligibility
Users and Service Providers must be at least 18 years of age and legally competent to enter into binding contracts under the Indian Contract Act, 1872.
You agree to provide accurate, complete, and updated information. Submission of false, misleading, or fraudulent information may result in suspension or termination.
User Accounts & Security
Users are responsible for maintaining the confidentiality of account credentials and all activities conducted through their account. Any unauthorized access must be reported immediately.
The Company reserves the right to suspend, restrict, or terminate accounts in cases of:

Misuse of the Platform

Legal or regulatory requirements
Booking & Service Process
Users may browse and select Service Providers directly or submit service requests. The Platform may match Users with suitable providers based on availability and service requirements.
Once connected, the Service Provider contacts the User directly. All terms including pricing, scope of work, materials, timeline, and execution are mutually agreed between the User and Service Provider.
The Company is not a party to such agreements.
Pricing, Payments & Taxes
All pricing is determined solely by Service Providers unless explicitly stated otherwise. The Company does not fix or regulate pricing.
Payments may be made directly to Service Providers or through third-party gateways such as Razorpay or Stripe.
The Company shall not be liable for:

Overcharging or hidden charges

Payment failures or delays
Applicable taxes (including GST) shall be governed by applicable law and are the responsibility of the Service Provider unless stated otherwise.
Refund, Cancellation & Disputes
Refund and cancellation policies are determined by individual Service Providers. Platform fees (if any) are refundable only if no Service Provider has been assigned.
The Company may facilitate communication in disputes but does not guarantee refunds or compensation.
These provisions align with the Consumer Protection Act, 2019.
User Conduct
Users agree not to:

Violate applicable laws or regulations

Provide false or misleading information

Harass, abuse, or threaten Service Providers

Attempt to disrupt or compromise Platform security
Violation may result in account suspension, termination, and/or legal action.
Intellectual Property
All Platform content, including logos, design, text, software, and trademarks, is owned by Ankira Infotech Private Limited and protected under the Copyright Act, 1957 and the Trade Marks Act, 1999.
Unauthorized use, reproduction, modification, or distribution is strictly prohibited.
Intermediary Protection
The Company operates as an intermediary under the Information Technology Act, 2000 and shall not be liable for third-party content, listings, or services, subject to compliance with applicable legal provisions.
Limitation of Liability
To the maximum extent permitted by law, WrightCare shall not be liable for:

Delays or non-performance

Loss of data, profit, or business

Indirect, incidental, or consequential damages
Indemnity
Users and Service Providers agree to indemnify and hold harmless the Company, its directors, employees, and affiliates from any claims, damages, losses, or legal proceedings arising from:

Privacy & Data Protection
Personal data is processed in accordance with the Digital Personal Data Protection Act, 2023 and the Information Technology Act, 2000.
Data may be collected for service coordination, verification, communication, fraud prevention, and legal compliance. Users have rights to access, correct, or delete data, subject to legal obligations.
Force Majeure
The Company shall not be liable for delays or failures caused by events beyond its reasonable control, including natural disasters, government actions, network failures, or technical disruptions.

The Company reserves the right to suspend or terminate access without prior notice for:

No Guarantee of Work
The Platform does not guarantee job assignments, income, or service frequency. Opportunities depend on demand, location, and availability.
Communication Consent
Users consent to receive calls, SMS, WhatsApp messages, and emails for service-related communication and updates.
Amendments
The Company reserves the right to modify these Terms at any time without prior notice. Continued use constitutes acceptance of the updated Terms.
Governing Law & Jurisdiction
These Terms shall be governed by the laws of India. Courts located at Prayagra, Uttar Pradesh shall have exclusive jurisdiction.
Grievance Redressal
In accordance with applicable laws, grievances shall be acknowledged within 48 hours and resolved within 30 days.

Mobile App & Play Store Compliance
The WrightCare mobile application complies with policies of Google Play Store. The app may request permissions strictly for functionality and collects limited data in compliance with applicable laws. Payments are processed via secure gateways such as Razorpay, Stripe or any other gateways as decided by the Company.
The app does not store sensitive financial data and allows account deletion upon request. It is not intended for users below 18 years of age.

By using WrightCare, you confirm that you have read, understood, and agreed to these Terms, including the Privacy Policy and Service Provider Agreement.
